How We Use Your Personal Information

• Providing Products and Services. We use your personal information to provide you with the Services in order to perform our contract with you, including to process your payments, fulfill your orders, to send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges and other features and functionalities related to your account. We may also enhance your shopping experience by enabling Shopify to match your account with other Shopify services that you may choose to use. In this case, Shopify will process your information as set forth in its Privacy Policy and Consumer Privacy Policy.

• Marketing and Advertising. We may use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you advertisements for products or services. This may include using your personal information to better tailor the Services and advertising on our Website and other websites where you have opted in.

• Security and Fraud Prevention. We use your personal information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately.

Like many websites, we use Cookies on our Website. For specific information about the Cookies that we use related to powering our store with Shopify, see https://www.shopify.com/legal/cookies. We use Cookies to power and improve our Website and our Services (including to remember your actions and preferences), to run analytics and better understand user interaction with the Services (in our legitimate interests to administer, improve and optimize the Services). We may also permit third parties and services providers to use Cookies on our Website to better tailor the services, products and advertising on our Website and other websites.

We do not use or disclose sensitive personal information without your consent or for the purposes of inferring characteristics about you.

With your consent we share personal information for the purpose of engaging in targeted advertising and marketing activities, as follows.

We have “sold” and “shared” (as those terms are defined in applicable law) personal information over the preceding 12 months for the purpose of engaging in advertising and marketing activities, as follows.

Third Party Websites and Links

Our Website may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

GA4 Data Collection

Data Collection: GA4 can collect data before consent if a business turns it on, but the default option is to collect after consent. Coconut Cult uses the default option and does not track user data unless consent is provided. 

Data Sharing: GA4 does not share data with third parties, except for Google Analytics.

Data Storage: GA4 stores Shopify webhook data for seven days for infrastructure reasons, and then deletes it. It also stores non-personal identifiable information, such as client IDs and session IDs, for a maximum of 14 days.

User Privacy: GA4 prioritizes user privacy by minimizing unnecessary data collection through an event-based data model. Each event only contains the essential data needed to describe it. 

 

Children's Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.

As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

Security and Retention of Your Information

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee “perfect security.” In addition, any information you send to us may not be secure while in transit. We recommend that you do not use insecure channels to communicate sensitive or confidential information to us.

International Users

Please note that we may transfer, store and process your personal information outside the country you live in. Your personal information is also processed by staff and third party service providers and partners in these countries.

If we transfer your personal information out of Europe, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.

SMS Service

This part of the Privacy Policy governs how we treat the Personal Information that we collect and receive from you in connection with your use of the SMS Service, which we make available to you through a third-party service provider. 

By using the SMS Service, you agree to the terms herein. The Coconut Cult reserves the right, in its sole discretion, to modify or change its SMS Service and the policies associated with it at any time with or without prior notice to you. The date of the last update will be posted at the top of this Privacy Policy for your convenience. This SMS Service, and any changes to the policies, are effective as soon as posted. Your continued use of the SMS Service following the posting of any changes to the Privacy Policy, including this section, constitutes your full acceptance of those changes.

“SMS Personal Information” is information that is collected through the SMS Service and that individually identifies you, such as your mobile phone number or user/screen name, as well as any Personal Information that you choose to include in messages you send through the SMS Service.

What SMS Personal Information is collected about you

Through the use of the SMS Service, The Coconut Cult will receive the following information from our third party service provider: your mobile phone number when you send a text message to us, the text of messages that you send to other users of the SMS Service, any user or screen name that you select in connection with the SMS Service, as well as any comments or feedback regarding the SMS Service that you send to us.

How The Coconut Cult uses SMS Personal Information about you

We use SMS Personal Information to (a) provide you with the SMS Service, (b) process and respond to inquiries, (c) improve the SMS Service, (d) if necessary, contact you with important announcements or messages, (e) conduct research, and (f) provide anonymous reporting for internal and external clients and partners.

Each message that you send through the SMS Service (either to us or to other users of the SMS Service) is stored on our servers. We retain these messages on our servers. The Coconut Cult utilizes servers and services owned by third parties to provide you with the SMS Service.

Disclosure of your information

We will not rent or sell your SMS Personal Information to other companies or individuals, unless we have your consent. We may use or disclose such information in any of the following limited circumstances, for example when:

• We have your consent.

• We need to enforce our Terms of Service.

• We provide such information to trusted businesses or persons for the sole purpose of processing SMS Personal Information on our behalf. When this is done, it is subject to agreements that oblige those parties to process such information only on our instructions and in compliance with our policies and appropriate confidentiality and security measures.  If the third party fails to comply with our terms, The Coconut Cult  is not accountable in any way for any liability or reimbursement.

• We provide such information to third parties who have entered into non-disclosure agreements with us.

• We provide such information to a company controlled by, or under common control with, The Coconut Cult for any purpose permitted by this Privacy Policy.

• We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights, or the legal rights of others, or defend against legal claims.

• We believe it is necessary to share SMS Personal Information to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of The Coconut Cult’s Terms of Service, or as otherwise required by law.

• We transfer SMS Personal Information about you if The Coconut Cult is, or its assets are, acquired by or merged with another company.

We may share aggregated information with others without further notice. An example of this would be the number of people who used the SMS Service in a given month or the total number of texts sent in a given week.

Security

The Coconut Cult takes precautions to ensure the security of your SMS Personal Information, including ensuring that our third party service providers protect the security of your SMS Personal Information. However, we cannot guarantee that hackers or unauthorized personnel will not gain access to your SMS Personal Information despite our efforts. You should note that in using the SMS Service, your information will travel through third party infrastructures which are not under our control (such as a third party SMS delivery platform or your carrier network).

We cannot protect, nor does this Privacy Policy apply to, any information that you transmit to other users. You should never transmit personal or identifying information or confidential/sensitive information to other users via the SMS Service.

Opting in

A mobile user might opt-in by:

• Entering a phone number online,

• Sending an Mobile Originating (MO) message containing an advertising keyword,

• Filling out a paper form that includes their phone number, or

• Signing up at a point-of-sale location.

Opting out

The Coconut Cult’s third-party service provider gives you the ability to opt out of the SMS Service for any reason. You can opt out by texting “STOP” to +1 (844) 981-0549.

We reserve the right to send you certain communications relating to the SMS Service, such as announcements and administrative messages, without offering you the opportunity to opt-out of receiving them.
